Welcome to MCPhacker. These Terms of Service ("Terms," "Agreement") govern your access to and use of the MCPhacker security scanning platform, website, APIs, and all related services (collectively, the "Service") operated by MCPhacker ("we," "us," "our," "MCPhacker," or the "Company").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.


1. Definitions

  • "Service" means the MCPhacker security scanning platform, including the web application, APIs, scanning engine, scan results, reports, and all related tools and features.
  • "User," "you," "your" means any individual or entity that accesses or uses the Service.
  • "Scan" means the automated security testing process performed by the Service against a specified MCP (Model Context Protocol) server endpoint.
  • "Scan Target" means the MCP server URL, endpoint, or system that you submit for scanning through the Service.
  • "Scan Results" means the output, findings, reports, vulnerability assessments, and any data generated by the Service as a result of performing a Scan.
  • "Account" means your registered user account on the Service.
  • "License" means the license tier you have purchased or are using (Free tier, 6-month license, 1-year license, or lifetime license), which determines your access level, usage limits, and available features.
  • "Content" means any data, text, information, or materials submitted to or generated by the Service.
  • "Authorized Scanning" means scanning performed against Scan Targets that you own or for which you have obtained explicit, written authorization from the owner to perform security testing.

2. Service Description

MCPhacker is a security scanning and vulnerability assessment platform designed for MCP (Model Context Protocol) servers. The Service provides automated security testing capabilities including, but not limited to:

  • Injection vulnerability detection (SQL injection, NoSQL injection, command injection, template injection)
  • Authentication and authorization bypass testing
  • Server-Side Request Forgery (SSRF) detection
  • Prompt injection vulnerability assessment
  • Transport layer security analysis (TLS, CORS configuration)
  • Path traversal and directory traversal testing
  • Rate limiting and denial-of-service resilience evaluation
  • AI-powered vulnerability analysis and reporting

The Service utilizes third-party artificial intelligence models (via OpenRouter API) to analyze scan data and provide security insights. AI-generated analysis is provided on a best-effort basis and should not be treated as definitive security advice.

MCPhacker is a tool that assists with security assessment. It does not replace professional security audits, penetration testing services, or expert security consultation. Users are solely responsible for validating all findings and determining appropriate remediation actions.


3. Account Registration and Authentication

3.1 Account Creation

To use the Service, you must create an Account by providing a valid email address. We use a passwordless authentication system: a one-time login link is sent to your registered email address each time you wish to access the Service.

3.2 Account Responsibilities

You are responsible for:

  • Providing accurate and current email address information.
  • Maintaining the security of your email account, which serves as the sole authentication mechanism for the Service.
  • Remembering and securely storing your encryption passphrase. Your passphrase is used to encrypt and decrypt your scan data. If you forget your passphrase, we cannot recover it, and your encrypted scan data will become permanently inaccessible. There is no passphrase recovery or reset mechanism.
  • All activity that occurs under your Account, whether or not authorized by you.
  • Immediately notifying us at the contact information provided below if you believe your Account has been compromised.

3.3 Account Restrictions

You may not:

  • Create multiple Accounts to circumvent license limitations or usage restrictions.
  • Share your Account credentials, login links, or encryption passphrase with any third party.
  • Transfer your Account to another person or entity without our prior written consent.
  • Use another person's Account without their express permission.

3.4 Account Eligibility

You must be at least 18 years of age to create an Account and use the Service. By creating an Account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. The Service is not intended for use by individuals under the age of 13, in compliance with the Children's Online Privacy Protection Act (COPPA).


4. License Tiers and Limitations

4.1 License Tiers

The Service is offered under the following license tiers:

  • Free Tier: Provides limited access to the Service with restricted scan frequency, scan depth, and feature availability as described on our pricing page. The free tier has no expiration date but includes the lowest usage limits and shortest data retention period.
  • 6-Month License: Provides enhanced access with increased scan limits, additional vulnerability checks, and advanced features for a period of 6 months from the date of purchase, as described on our pricing page.
  • 1-Year License: Provides enhanced access with increased scan limits, additional vulnerability checks, and advanced features for a period of 1 year from the date of purchase, as described on our pricing page.
  • Lifetime License: Provides the highest tier of access with the highest scan limits, all available features, and unlimited duration, as described on our pricing page.

4.2 License Limitations

Each License tier includes specific usage limits including, but not limited to, the number of scans per day, concurrent scan capacity, scan depth, number of vulnerability categories tested, and data retention periods. These limits are described on our pricing page and may be updated from time to time.

4.3 Exceeding License Limits

If you exceed the usage limits of your License tier, we may throttle, suspend, or restrict your access to the Service until the next day (for daily rate limits) or until you purchase a higher License tier. We will make reasonable efforts to notify you when you approach or exceed your License limits.

4.4 License Expiration and Data Retention

  • 6-Month and 1-Year Licenses: When your license expires, your account will revert to the Free Tier. Your encrypted scan data will be retained for 30 days after license expiration, after which it will be permanently deleted. You may purchase a new license at any time to regain access to enhanced features and restore your data retention period.
  • Lifetime License: Does not expire. Your encrypted scan data is retained for the duration of your account existence.
  • Free Tier: Encrypted scan data is retained for 30 days.

4.5 Changes to License Tiers

We reserve the right to modify, discontinue, or introduce new license tiers at any time. Changes to existing license tier features or pricing will not affect licenses that have already been purchased. New purchases after such changes will be subject to the updated terms. Changes will be communicated to you at least thirty (30) days in advance.

4.6 Payment Terms

Payment processing for paid Licenses is handled by Stripe, a third-party payment processor. MCPhacker does not directly collect, store, or process payment card data. Your use of Stripe is subject to Stripe's own terms of service and privacy policy.

Payment Structure: - All license purchases are one-time payments, not recurring subscriptions. - There are no automatic renewals or recurring charges. - When a time-limited license (6-month or 1-year) expires, you must manually purchase a new license if you wish to continue using enhanced features. - All fees are non-refundable except as expressly stated in these Terms or as required by applicable law.

4.7 No Refunds

License purchases are final and non-refundable. Once a license is activated, no refunds will be issued, except as required by applicable law. If you experience technical issues that prevent you from using the Service, please contact support for assistance, but refunds are not guaranteed.


5. Authorized Use and Legal Compliance

5.1 Authorization Requirement

YOU MAY ONLY USE THE SERVICE TO SCAN MCP SERVERS THAT YOU OWN OR FOR WHICH YOU HAVE OBTAINED EXPLICIT, WRITTEN AUTHORIZATION FROM THE OWNER TO PERFORM SECURITY TESTING.

This is a fundamental condition of your use of the Service. Unauthorized security scanning of computer systems may violate federal, state, and international laws, including but not limited to the Computer Fraud and Abuse Act (18 U.S.C. Section 1030) ("CFAA"), the California Comprehensive Computer Data Access and Fraud Act (Cal. Penal Code Section 502), and equivalent laws in other jurisdictions.

5.2 CFAA Compliance

The Computer Fraud and Abuse Act (CFAA) prohibits accessing a computer without authorization or in excess of authorized access. By using the Service, you acknowledge and agree that:

  • You are solely responsible for ensuring that you have proper authorization to scan any Scan Target submitted to the Service.
  • MCPhacker does not verify and cannot verify whether you have authorization to scan a given target. Due to our zero-knowledge architecture, we do not have access to your scan targets or scan results. The Service processes encrypted scan requests as submitted by the User.
  • You represent and warrant that each Scan Target you submit is either (a) owned by you, or (b) you possess current, valid, written authorization from the owner of the Scan Target to perform the type of security testing conducted by the Service.
  • Unauthorized scanning constitutes a violation of these Terms and may expose you to criminal prosecution and civil liability under the CFAA and other applicable laws.
  • You will maintain records of all authorizations for Scan Targets and will provide copies to MCPhacker upon request.

5.3 Your Responsibility

MCPhacker provides a security scanning tool. You, the User, bear full and sole responsibility for:

  • Obtaining and maintaining proper authorization before initiating any Scan.
  • Ensuring that your use of the Service complies with all applicable federal, state, local, and international laws and regulations.
  • Any consequences, legal or otherwise, arising from your use of the Service, including any scans you initiate.
  • Any damage caused to Scan Targets or third-party systems as a result of scans you initiate through the Service.

5.4 No Agency or Authorization from MCPhacker

Your use of the Service does not constitute authorization from MCPhacker, express or implied, to access any third-party system. MCPhacker does not grant, imply, or represent that using the Service provides legal authorization to scan any system.


6. Prohibited Uses

You agree not to use the Service to:

1. Scan unauthorized targets: Perform scans against any MCP server, system, or endpoint for which you do not have explicit, written authorization from the owner. 2. Exploit vulnerabilities: Use Scan Results or information obtained through the Service to exploit, attack, or gain unauthorized access to any system. 3. Distribute vulnerability data: Sell, trade, distribute, publish, or disclose vulnerability information obtained through the Service to any third party without proper authorization, except through responsible disclosure channels. 4. Cause denial of service: Use the Service in a manner that overwhelms, degrades, or disrupts the Scan Target or any other system, or that could be characterized as a denial-of-service attack. 5. Engage in malicious activities: Use the Service for any malicious, harmful, fraudulent, or illegal purpose, including but not limited to hacking, cracking, phishing, or distributing malware. 6. Circumvent controls: Attempt to bypass, circumvent, or disable any rate limits, usage restrictions, License limitations, security features, or access controls of the Service. 7. Reverse engineer: Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying technology of the Service's scanning engine or any component thereof. 8. Automated mass scanning: Use automated scripts, bots, crawlers, or other automated means to submit scan requests beyond the limits of your Plan or in a manner that places an unreasonable load on the Service. 9. Account abuse: Create multiple accounts, share accounts, or transfer accounts to circumvent License limitations or these Terms. 10. Impersonation: Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity. 11. Interfere with the Service: Introduce viruses, trojan horses, worms, or other malicious code to the Service, or attempt to gain unauthorized access to the Service, other user accounts, or associated systems. 12. Violate laws: Use the Service in any manner that violates any applicable federal, state, local, or international law or regulation. 13. Competitive purposes: Access the Service for the purpose of building a competing product or service, or for benchmarking or competitive analysis.


7. Intellectual Property

7.1 MCPhacker's Intellectual Property

The Service, including its design, functionality, scanning engine, algorithms, software, user interface, documentation, trademarks, logos, and all related intellectual property, is and shall remain the exclusive property of MCPhacker and its licensors. These Terms do not grant you any right, title, or interest in the Service or our intellectual property, except for the limited right to use the Service in accordance with these Terms.

7.2 User Content

You retain ownership of the data you submit to the Service, including Scan Target URLs and any configurations you provide. However, you grant MCPhacker a non-exclusive, worldwide, royalty-free license to use, process, store, and transmit such data solely for the purpose of providing and improving the Service.

7.3 Scan Results

Scan Results generated by the Service are provided to you under a limited license for your internal security assessment purposes. You may use Scan Results to remediate vulnerabilities in systems you own or are authorized to manage. You may not sell, license, or commercially distribute raw Scan Results as a standalone product or service.

7.4 Feedback

If you provide suggestions, feedback, or ideas regarding the Service ("Feedback"), you grant MCPhacker an irrevocable, perpetual, worldwide, royalty-free license to use, modify, and incorporate such Feedback into the Service without any obligation to you.

7.5 Aggregate and Anonymized Data

MCPhacker may collect and use aggregate, anonymized, and de-identified data derived from your use of the Service for purposes including but not limited to improving the Service, conducting research, generating industry reports, and developing new features. Such data will not identify you or any specific Scan Target.


8. Third-Party Services

8.1 AI Analysis Services

The Service utilizes third-party artificial intelligence models (currently accessed via the OpenRouter API) to perform vulnerability analysis on scan data. AI analysis is an optional feature that is disabled by default. By explicitly enabling AI analysis for a scan, you acknowledge and consent to your scan data being transmitted to and processed by these third-party AI services in plaintext form before client-side encryption. MCPhacker uses a preset configuration on OpenRouter, meaning your data may be routed to various large language model (LLM) providers selected by OpenRouter. MCPhacker does not control which specific AI model processes your data, nor how third-party providers process, store, retain, or use your data.

After AI analysis is complete, the results are encrypted client-side before storage. MCPhacker selects AI providers that maintain commercially reasonable data handling practices, but MCPhacker does not control the data retention or processing practices of these third-party providers. Once data is transmitted to third-party AI providers, MCPhacker cannot guarantee its deletion, confidentiality, or security.

Pursuant to Section 230 of the Communications Decency Act (47 U.S.C. § 230), MCPhacker shall not be treated as the publisher or speaker of any AI-generated content. MCPhacker is not liable for the outputs, errors, omissions, or data handling practices of third-party AI providers. Your voluntary enablement of AI analysis constitutes informed consent to third-party data processing under applicable United States federal and Delaware state law.

For maximum data privacy, MCPhacker recommends using the Service without AI analysis enabled. The core scanning engine operates entirely locally without transmitting data to any third party. See our Disclaimer for full details on AI data sharing.

8.2 Email Services

The Service uses third-party email delivery services (currently Resend) to send authentication emails and notifications. Your email address is shared with these providers solely for the purpose of delivering emails related to the Service.

8.3 Payment Processing

Paid License purchases are processed through Stripe, a third-party payment processor. MCPhacker does not directly handle, store, or process payment card information. Your use of Stripe is subject to Stripe's terms of service and privacy policy.

8.4 Third-Party Terms

Your use of any third-party service accessed through or integrated with the Service is subject to that third party's own terms of service and privacy policy. MCPhacker is not responsible for the availability, accuracy, or practices of any third-party service.


9. Privacy and Zero-Knowledge Architecture

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Zero-Knowledge Architecture: The Service is designed with a zero-knowledge architecture. Your scan targets, scan results, and vulnerability findings are encrypted client-side in your browser before transmission to our servers. MCPhacker does not have access to your encryption passphrase and cannot decrypt or access your scan data. This means:

  • We cannot view, inspect, or verify the content of your scans.
  • We cannot provide technical support that requires access to your scan data.
  • We cannot recover your data if you forget your encryption passphrase.
  • Law enforcement or legal requests for your scan data cannot be fulfilled, as we do not have access to the plaintext data.

Passphrase Responsibility: You are solely responsible for remembering and securely storing your encryption passphrase. If you lose your passphrase, your scan data will become permanently inaccessible, and we cannot assist in recovering it. By using the Service, you acknowledge and accept this responsibility and limitation.


10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MCPHACKER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES of merchantability, fitness for a particular purpose, and non-infringement.
  • WARRANTIES OF ACCURACY or completeness of Scan Results, vulnerability assessments, AI-generated analysis, or any other output of the Service.
  • WARRANTIES OF AVAILABILITY that the Service will be uninterrupted, timely, secure, or error-free.
  • WARRANTIES OF COMPLETENESS that the Service will detect all vulnerabilities, security issues, or weaknesses in any Scan Target.
  • WARRANTIES AGAINST FALSE RESULTS that Scan Results will not contain false positives (reporting vulnerabilities that do not exist) or false negatives (failing to detect vulnerabilities that do exist).

YOU ACKNOWLEDGE THAT:

  • No security scanning tool can guarantee the detection of all vulnerabilities.
  • Scan Results are generated through automated processes and AI analysis and may be inaccurate, incomplete, or misleading.
  • The Service does not constitute professional security advice, a professional security audit, or a penetration test conducted by qualified security professionals.
  • You are solely responsible for independently validating all Scan Results and determining appropriate remediation actions.
  • The absence of reported vulnerabilities does not mean a system is secure.
  • Security landscapes evolve rapidly, and new vulnerabilities may emerge after a scan is completed.
  • Due to the zero-knowledge architecture, MCPhacker cannot verify or inspect your scan data and therefore cannot be held responsible for the content, accuracy, or use of encrypted scan data.
  • If you forget your encryption passphrase, all of your scan data will become permanently inaccessible, and MCPhacker has no ability to recover it.

11. Limitation of Liability

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MCPHACKER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, business opportunities, or goodwill.
  • Cost of procurement of substitute goods or services.
  • Damages arising from unauthorized access to or alteration of your transmissions or data.
  • Damages arising from your reliance on Scan Results, AI-generated analysis, or any other output of the Service.
  • Damages arising from the actions of any third party, including other users of the Service.
  • Damages arising from any unauthorized scanning or testing performed by you using the Service.
  • Damages to any Scan Target or third-party system resulting from scans initiated by you.

11.2 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MCPHACKER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO MCPHACKER FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

11.3 Basis of the Bargain

THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF MCPHACKER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS ARE AN ESSENTIAL ELEMENT OF THE BARGAIN BETWEEN YOU AND MCPHACKER.

11.4 Jurisdictional Limitations

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, MCPHACKER'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.


12. Indemnification

12.1 Your Indemnification Obligations

You agree to indemnify, defend, and hold harmless MCPhacker, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

  • Your use of the Service, including any scans you initiate.
  • Your violation of these Terms or any applicable law or regulation.
  • Your unauthorized scanning of any system or endpoint.
  • Any claim by a third party that your use of the Service infringed upon, violated, or misappropriated their rights, including intellectual property rights or privacy rights.
  • Any damage, disruption, or unauthorized access to any third-party system resulting from your use of the Service.
  • Your failure to obtain proper authorization before scanning any Scan Target.
  • Any claim arising under the Computer Fraud and Abuse Act (CFAA) or equivalent laws resulting from your use of the Service.
  • Your use, misuse, or distribution of Scan Results.

12.2 Indemnification Procedure

MCPhacker will promptly notify you of any claim subject to indemnification and will provide reasonable cooperation at your expense. MCPhacker reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You shall not settle any claim without MCPhacker's prior written consent.


13. Termination

13.1 Termination by You

You may terminate your Account and stop using the Service at any time by contacting us at the email address provided below. Upon termination, your right to access the Service will cease immediately.

13.2 Termination by MCPhacker

MCPhacker may suspend or terminate your Account and access to the Service, in whole or in part, at any time and for any reason, including but not limited to:

  • Violation of these Terms, the Acceptable Use Policy, or any other MCPhacker policy.
  • Unauthorized scanning of third-party systems.
  • Conduct that MCPhacker determines, in its sole discretion, may expose MCPhacker to legal liability.
  • Conduct that MCPhacker determines is harmful to other users, third parties, or the Service.
  • Extended periods of Account inactivity.
  • Discontinuation of the Service or any part thereof.

13.3 Effect of Termination

Upon termination of your Account:

  • Your right to access and use the Service will immediately cease.
  • MCPhacker may delete your Account data, including encrypted scan data, in accordance with our data retention policies as described in our Privacy Policy.
  • Your purchased license (if any) will be forfeited, and no refunds will be issued.
  • Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 7 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law), and 15 (Dispute Resolution).

13.4 No Refunds on Termination

Unless otherwise required by applicable law, no refunds will be issued for any purchased licenses upon termination of your Account, whether terminated by you or by MCPhacker for cause. License purchases are one-time, non-refundable payments.


14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. You agree that any legal action or proceeding relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.


15. Dispute Resolution

15.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact MCPhacker and attempt to resolve the dispute informally for at least thirty (30) days. You may initiate this informal process by sending a written description of the dispute to the contact email address provided below.

15.2 Binding Arbitration

If the dispute cannot be resolved informally within thirty (30) days, you and MCPhacker agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in the State of Delaware.

15.3 Arbitration Procedures

The arbitrator shall have exclusive authority to resolve all disputes, including the scope and enforceability of this arbitration provision. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs of arbitration, except as otherwise provided by the AAA rules or as ordered by the arbitrator.

15.4 Class Action Waiver

YOU AND MCPHACKER AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator shall not have the authority to conduct class-wide arbitration or to consolidate claims brought by or against different individuals.

15.5 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidential information, or other proprietary rights.

15.6 Small Claims Court

Either party may bring an individual action in small claims court in the State of Delaware if the claim falls within the court's jurisdictional limits.


16. Changes to These Terms

MCPhacker reserves the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by:

  • Posting the updated Terms on the Service with a revised "Last Updated" date.
  • Sending a notice to the email address associated with your Account.

Material changes will be effective thirty (30) days after notification. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may terminate your Account.
